The Site presents consumer wellness products sold by independent sellers; it does not sell them itself. You can reach us at support@thewellcart.com.

These Terms of Use (“Terms”) govern your use of the Site. By using the Site you accept them together with our Privacy Notice, Shipping & Returns summary and Disclaimer, which form part of these Terms. Effective date: October 3, 2026.

1. What the Site is

The Site is a catalog. It lists products with the facts their sellers publish (pack size, ingredients, directions) and the seller’s single-unit price in US dollars (USD) as last checked by us. Every “Buy” link on the Site leads to a checkout page operated by the seller of that product — the seller operating the checkout page you are redirected to (the “Seller”), and that page the “Seller Checkout”. The Seller is named on the Seller Checkout. The Company is not a party to any order placed on a Seller Checkout.

Products marked “Coming soon” are listed for information only. They cannot be ordered through the Site or through us, and the Site offers no waiting list, pre-order or e-mail capture for them.

2. Orders are concluded on the Seller Checkout

When you click “Buy” you leave the Site and continue to the Seller Checkout. The contract of sale is concluded there between you and the Seller under its own terms of sale, privacy policy, shipping policy and return policy, which are shown on that checkout page. Payment is taken by the Seller; the order confirmation, tracking information, delivery, returns, refunds and customer support for the order come from it.

The Company does not take payment, hold stock, dispatch goods, issue invoices or process returns. Questions about an order must be addressed to the seller named on the checkout page and in your confirmation e-mail.

3. Prices and product information

Prices on the Site are shown in US dollars (USD) and are the Seller’s own single-unit prices at the time we last checked them; larger pack sizes are listed with their total price and the equivalent price per unit. The price, shipping charge and any tax that apply to your order are the ones displayed on the Seller Checkout before you confirm. If a price on the Site differs from the Seller Checkout, the Seller Checkout prevails.

Product descriptions on the Site repeat the facts the Seller publishes about its product. The label, directions and warnings on the pack prevail over any description on the Site. Images are for illustration. We may correct, update or remove a listing at any time without notice.

4. Use of the Site

You must be at least 18 years old to use the Seller Checkouts. You may use the Site for personal, non-commercial purposes only. You must not interfere with the Site, scrape it, misrepresent your identity or use it for any unlawful purpose.

The Site, its layout and its text are owned by the Company or used with permission. Product images and packaging shown on the Site belong to their respective owners and are shown only to identify the products listed; their use on the Site does not imply any endorsement of the Site by those owners beyond the listing itself.

5. Links to third parties

The Seller Checkouts are operated by third parties. We do not control them and are not responsible for their content, availability, terms or privacy practices. The link on the Site passes the name of this Site to the Seller Checkout (the “utm_domain” parameter) so the Seller knows where you came from; it passes no personal data.

6. Disclaimer of warranties

The Site is provided “as is”. To the fullest extent permitted by law we exclude all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose, and we do not warrant that the Site will be uninterrupted, error-free or that a listing is current. Nothing on the Site is medical, nutritional or other professional advice; see the Disclaimer.

7. Limitation of liability

To the fullest extent permitted by law, the Company is not liable for any loss arising from an order placed on a Seller Checkout, for the acts or omissions of a Seller, or for any indirect, incidental or consequential loss arising from the use of the Site. Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence or for fraud.

8. Governing law and disputes

These Terms are governed by the laws of the State of [STATE], United States of America. Any dispute about the Site that cannot be settled by e-mail will be brought before the state and federal courts located in the State of [STATE] (for claims within its limit, the small claims court of that state). If you are a consumer living outside the United States, you also keep the protection of the mandatory consumer laws of the country where you live.
